McMahan Land Dispute Settlement

Identifier: MM.2020.018

Scope and Contents

The McMahan Clan of Jones Cove, Sevier County (Tenn.) 1857 state land grant, concerning land settlement dispute between the heirs of Archibald W. McMahan, decd. and his brother, William decd., (both mentioned) filed by brother Robert L. McMahan, beginning in 1864 (death of Wm.) To Judge O.P. Temple Chancellor Presiding at Sevierville, from Hon. G. W. Pickle of Sevier and Cocke Co. Robt. McMahan vs. Rebecca McMahan, Sept. 4, 1871,

1864 thru 1871 (period of contest) handwritten by Pickle, naming all the heirs, including minors and their guardians. It appears as if this division of property was supposed to already have been agreed upon, and was to have been by sale of all property, some bought at court ordered auction by David McMahan in behalf of Robt. L. McMahan in 1865, which the court decreed unacceptable but after Robt. had already paid for in full and made significant improvements to the property. The guardians of the minors have already received and appropriated the monies from the sale and lawyer Pickle requests that the court recognize this sale as legal or else return all purchase monies to Orator Robt. L. McMahan, Rebecca T. McMahan, David McMahan, Wm. McMahan, Angeletta, Redmon, Rachael Wilson, David Redman McMahan, Elizabeth Brooks, Samuel McMahan, David McMahan,Sr. are also mentioned in this Cocke Co.copy of court document. This property bordered on the Sevier-Cocke Co. line and family lived in each county. The survey boundaries are noted by Pickle in this document and the land is stated to be 200 acres, bordering on Robt. McMahan's existing property.
